The Petitioners who are Members of Haveri Taluk Panchayat elected from Congress-I party tickets have filed the Petition under Section 4 of the Defection Act praying for disqualifying the Respondents on the ground that they violated the directions issued by the President of District Congress (I) Committee , Haveri District to vote in favour of the Petitioners for the offices of Adhyaksha and Upadhyaksha at the election held on 11/03/2002. It was contended by the Petitioners that the 3rd Respondent filed her nomination for the office of Adhyaksha and contested against the 1st Petitioner and another Congress -I party Member Sri Guddanagowda C Mudigowda filed his nomination for the office of Upadhyaksha and contested against the 2nd Petitioner . That they cast their votes at the said election contrary to the directions issued by the Congress -I Party.

Since the Petitioners failed to prosecute the Complaint ,by an order dated 11th October 2002 dismissed the petition.
